12 arrested in fake yeshiva mega-fraud case
[IsraelNationalNews] 12 suspects were arrested in Beit Shemesh Monday in a massive fraud case involving a fake yeshiva.

According to the authorities, the suspects created a fake yeshiva and registered 150 'students' in order to receive government funding in the form of Education Ministry stipends and scholarship funds, Yeshiva World News reported.

The suspects allegedly pocketed over NIS 1,000,000 ($287,000).

During a routine inspection, Education Ministry officials found a pile of rubble at the address given for the yeshiva. The officials filed a complaint with the police and undercover detectives, who discovered that the yeshiva and its 150 students did not exist.

Near record cold New Year's Eve expected in New York City
[Fox5ny] If you plan on ringing in the new year at the annual ball drop in Times Square, expect to be cold. A severe blast of Arctic air has descended on the New York City region and temperatures will stay below the freezing mark around the clock for the rest of the year.
Gotta be all that global warming
On New Year's Eve the temperature is expected to drop to around 12 degrees, about 12 degrees below normal and one of the coldest on record. High temperatures leading into the holiday are expected to be colder than the typical low temperatures for those days.

Despite the cold, it is not expected to be a record for that date. In 1962 the temperature plunged to 2 degrees on New Year's Eve but that fact is little comfort for the upwards of one million people expected to spend hours outdoors waiting to ring in 2018.

It's too early to tell for sure but there are also some predictions that light snow could fall on New Year's Eve. The only good news with that is that clouds could help trap some warmth at the ground level.

The National Weather Service says the average forecast temperature for the next 7 days for Central Park will be 19 degrees with forecast highs in the low and middle 20s and lows in the middle teens.

New York City Emergency Management officials issued an extreme cold weather alert starting on Tuesday afternoon encouraging New Yorkers to stay indoors as much as possible. They warned that prolonged exposure to cold can contribute to health problems such as hypothermia, frostbite and exacerbation of chronic heart and lung conditions.

A Code Blue was issued for the homeless. People were asked to call 311 if they saw homeless people outside so that city workers could attempt to get them to go to a shelter.
Get used to the cold. You are gonna see a lot more of it.

Michael Flynn's brother to Trump: It's ‘about time you pardoned' him
[NY Post] Mike Flynn’s younger brother told President Trump it’s "about time" he pardoned "General Flynn" ‐ in a tweet he sent to the president and deleted minutes later.

Joseph Flynn, the brother of Trump’s ex-national security adviser, was responding to a tweet by Trump that criticized the FBI investigation into his campaign team and administration.

"About time you pardoned General Flynn who has taken the biggest fall for all of you given the illegitimacy of this confessed crime in the wake of all this corruption," Joseph Flynn tweeted.

When contacted by Newsweek, Joseph Flynn confirmed the Trump Tweet.

"I said it, and maybe he’s listening," the younger Flynn said.

Mike Flynn pleaded guilty to lying to the FBI earlier this month.

He is reportedly cooperating with authorities in the ongoing investigation into whether Trump officials colluded with Russia during the 2016 presidential campaign.

When asked recently whether he was considering a pardon for Flynn, Trump replied that he didn’t "want to talk about pardons with Michael Flynn yet."

"We’ll see what happens, let’s see," Trump said.

Supreme Court Tellingly Rejects Lower Court Roadblock to Elimination of DACA Program
[The Daily Signal] On Dec. 20, in an unsigned, four-page opinion, the Supreme Court struck down a lower court order that severely burdened efforts by the Trump administration to end the Obama administration’s Deferred Action for Childhood Arrivals program, which has shielded certain younger illegal aliens from deportation.

This is good news, a helpful sign that the Supreme Court will not give unelected judges carte blanche to hamstring the federal government’s legitimate efforts to enforce immigration law restrictions, consistent with the current statutory law.

Continuation of DACA offends the rule of law. As Heritage Foundation scholar Hans von Spakovsky has explained, DACA should be eliminated as a matter of law: "Why? Because the president doesn’t have the authority to decide who should be in the United States legally when it comes to immigrants. That power resides entirely in Congress [because] . . . the Constitution says it."

In short, allowing a category of illegal aliens not to be deported requires an act of Congress, not an arbitrary presidential decision.

DACA was established in 2012 by a Department of Homeland Security memorandum. It applied to a large number of young illegal aliens who met certain conditions: they illegally entered the U.S. before the age of 16; were under the age of 31; had "continuously" resided in the U.S. since June 15, 2007; and were in school, graduated, or honorably discharged from the military.

DACA provided a period of deferred action (a promise that the alien would not be deported) as well as access to certain government benefits (including work authorizations, Medicare, Social Security, and the earned income tax credit). The period of deferred action was initially for two years, but that period was extended to three years by a second DHS memorandum on Nov. 14, 2014.

Gun buyback program in St. Louis draws hundreds of people, weapons
[St. Louis Post-Dispatch] ST. LOUIS • Hundreds of people turned up Saturday morning for a well-publicized gun buyback opportunity that officials hope will make the community safer.

It was so popular that many left without their hoped-for holiday cash.

Lured by the promise of $100 to $200 per weapon, with no questions asked, participants schlepped bags full of pistols, rifles and shotguns, many of them old and rugged.

"My brother in Arkansas rabbit-hunted with it all last year," Willie Shelton, 67, of the city’s Penrose neighborhood, said of a pump 20-gauge shotgun that hadn’t been oiled in a long time. "It was just sitting in the corner, and I heard on the news that I could get $150."

Behind him, Stan Sisley toted a .22-caliber rifle in a guitar sack. The inherited gun had been in a storage unit in north St. Louis County. Around 10 a.m., he and his wife were at the very end of a line that zigzagged out the Omega Center, 3900 Goodfellow Boulevard, through the parking lot and down the block.

"Might as well get rid of it, and I could use the Christmas money," said Sisley, 62.

But he didn’t get the chance. After the couple waited in the cold more than two hours, he said, officials began turning people away at 12:15, unless they had assault weapons or wanted to donate their guns.

"I think maybe they didn’t expect the turnout that it was," he said. "Maybe they will be more prepared next time."

Doug Albrecht, president of the St. Louis Police Foundation, said $125,000 in donations was raised from the Bar Association of Metropolitan St. Louis, individuals and companies such as Ameren and Spire to pay for the guns.

Leading up to the event, Albrecht expected about 500 to 1,000 guns to be gathered and destroyed. Should there be more, he said then, more fundraising would be needed for another event in the new year.

December 2013: Federal agents found fetuses in body broker's warehouse
WASHINGTON (Reuters) - Federal agents discovered four preserved fetuses in the Detroit warehouse of a man who sold human body parts, confidential photographs reviewed by Reuters show.

The fetuses were found during a December 2013 raid of businessman Arthur Rathburn’s warehouse. The fetuses, which appear to have been in their second trimester, were submerged in a liquid that included human brain tissue.

Rathburn, a former body broker, is accused of defrauding customers by sending them diseased body parts. He has pleaded not guilty and his trial is set for January.

How Rathburn acquired the fetuses and what he intended to do with them is unclear. Rathburn’s lawyers did not respond to requests for comment, and neither the indictment nor other documents made public in his case mention the fetuses.

"This needs to be reviewed," said U.S. Representative Marsha Blackburn, a Republican from Tennessee who recently chaired a special U.S. House committee on the use of fetal tissue.

Pat Buchanan: Did the FBI Conspire to Stop Donald Trump?
[Townhall} The original question the FBI investigation of the Trump campaign was to answer was a simple one: Did he do it?

Did Trump, or officials with his knowledge, collude with Vladimir Putin's Russia to hack the emails of John Podesta and the DNC, and leak the contents to damage Hillary Clinton and elect Donald Trump?

A year and a half into the investigation, and, still, no "collusion" has been found. Yet the investigation goes on, at the demand of the never-Trump media and Beltway establishment. Hence, and understandably, suspicions have arisen.

Are the investigators after the truth, or are they after Trump? Set aside the Trump-Putin conspiracy theory momentarily, and consider a rival explanation for what is going down here:

That, from the outset, Director James Comey and an FBI camarilla were determined to stop Trump and elect Hillary Clinton. Having failed, they conspired to break Trump's presidency, overturn his mandate and bring him down.

Essential to any such project was first to block any indictment of Hillary for transmitting national security secrets over her private email server. That first objective was achieved 18 months ago.

On July 5, 2016, Comey stepped before a stunned press corps to declare that, given the evidence gathered by the FBI, "no reasonable prosecutor" would indict Clinton. Therefore, that was the course he, Comey, was recommending.

Attorney General Loretta Lynch, compromised by her infamous 35-minute tarmac meeting with Bill Clinton -- to discuss golf and grandkids -- seconded Comey's decision.

Israel in touch with 10 countries over embassy moves
[IS News Net] Doha - Israel's deputy foreign minister has said her government is"in contact with at least 10 countries" over the potential relocation of their embassies to Jerusalem.

Tzipi Hotovely's comments on Monday came a day afterGuatemala announced plans to move its embassy toJerusalem, following a similar decision by the US earlier this month which sparked widespread international condemnation and mass rallies across the Muslim world.

Speaking to state radio, Hotovely did not specify the countries in question but said "some" of them are "in Europe".

"So far we have only seen the beginning," she said, adding that US President Donald Trump's decision would "trigger a wave" of followers.

The status of Jerusalem is one of the main sticking points in efforts to resolve the Israeli-Palestinian conflict.

Palestinian leaders want occupied East Jerusalem as the capital of a future state, while Israel says the city cannot be divided.

Breaking with decades of policy, Trump announcedon December 6 that the US recognised Jerusalem as the capital of Israel and said his administration would be moving its embassy from Tel Aviv to the Holy City.

Currently, there are no embassies in Jerusalem.

Comrade De Blasio Not Happy With Peasants Riding E-Bikes
[PC] New York City mayor Bill De Blasio previously had a big problem with horse drawn carriages, which allowed the proletariat to make money to eat and shelter. Now he sets his sights on something else.

You have a mode a transportation that is good for the environment, and good for the low wage workers. Glad Bill and the city elders care about these things.

See? Bad for low wage workers (BTW, here 15 years and needs a translator? This is why many complain about illegal and legal immigration)

Wait a minute: de Blasio’s law enforcement is confiscating people’s property, property which is legal to own (but not, apparently, use) in NYC and New York State (state law takes precedence over local law)? They’re taking property away that could have cost a minimum of $500, and often in the thousands? How Progressive of Bill.

Pro-lifers want answers after Oregon admits to spending $1.8 million on abortions
[Wash Times] Oregon pro-life activists are asking for more transparency and oversight after the government admitted to wasting tens of millions of taxpayer dollars and impermissibly financing abortions with federal money.

Lois Anderson, executive director of Oregon Right to Life, said there is a "lax" attitude in the state when it comes to "following laws related to abortion."

"It’s disturbing but not surprising," Ms. Anderson said. "Our current administration in Oregon is not especially concerned with tracking how they’re paying for abortions. We use state funds to pay for almost half of all abortions in Oregon."

In a Nov. 17 letter to Gov. Kate Brown, Oregon Health Authority (OHA) Director Pat Allen documented the myriad ways in which the agency tasked with managing the state’s $9.3 billion Medicaid program has wasted or misallocated taxpayer dollars.

Among other things, Oregon overpaid $74 million in federal funds to "dual eligible" enrollees who were old enough to qualify for Medicare and poor enough to qualify for Medicaid, Mr. Allen said in the letter.

Bundy Mistrial Highlights Why the Right Distrusts the Feds
[American Spectator] Once again, federal prosecutors are seen at their worst.

As Washington conservatives question whether partisan FBI officials working for Special Counsel Robert Mueller have stacked the deck against President Donald Trump, a criminal case in Las Vegas points to the sort of federal prosecutorial abuses that give the right cause for paranoia.

On Wednesday, U.S. District Judge Gloria Navarro declared a mistrial in the infamous 2014 Bunkerville standoff case against rancher Cliven Bundy, his sons Ammon and Ryan, and co-defendant Ryan Payne, on the grounds that federal prosecutors improperly withheld evidence.

The standoff, in which both sides were armed, was a national news story that pitted a Western rancher against federal officialdom. Bureau of Land Management officials had tried to seize Bundy’s cattle following a decades-long dispute over grazing fees. The rancher had stopped paying federal grazing fees in 1993 to protest a BLM directive that he cut back on cattle grazing in order to accommodate the threatened desert tortoise.

In the course of the trial, Navarro found that prosecutors failed to share video surveillance, maps, and FBI interview reports with defense attorneys. "A mistrial in this case is the most suitable and only remedy available," Navarro explained.

While I agree the local police departments need heavier weapons for dealing with our "little buddies" from the ME and their moon god, I don't agree with giving IRS, BLM, and other departments APC's, M2's, and full body armor...the militarization of the Executive branch under Obama was a precursor to what we would have had with Hillary...a national security force sort of like the old KGB or the new whatever they call themselves now, they are STILL the old Stalinist NKVD as far as I'm concerned.

#6  Things started to go downhill during the period 1890 and 1910. The election of Woodrow Wilson sped the downhill slide by a factor of three. Coolidge managed to stop the slide, but not to rebuild the trust necessary for Representative government to thrive. It's been all downhill ever since. The destruction of the unelected bureaucrats and their fiefdoms is the only thing that will save the US. What Trump is doing is a beginning, but it's going to take a LOT of hard work to succeed.

Robert Mueller May Indict Paul Manafort Again
[DailyBeast] "Flynn did not disclose payments received from Russia in 2015 nor Turkey in 2016 on his Security Disclosure forms," Sheil said. “What is the likelihood he reported these sums on his tax returns?”
And what is the likelihood General Flynn disclosed the subject payments on his financial disclosure report and a national security questionnaire?

#5  Mueller's team is in a big bind. How do they prove in court that the "new" evidence was not found using the "old and tainted" evidence. If there is a link one to the other, they are screwed. Even if a lead is found in the tainted evidence that gives them a new direction in the investigation, they are completely f**ked.

Oh BTW, most of what Manafort is being drilled on is his role in aiding Russian lobbying and influence peddling PRIOR to DJT deciding to run for POTUS. Do you support they are trying to smear Manafort to make his testimony unreliable in court when DoJ gets around to prosecuting Uranium One? He was a prime moving in the Russian efforts to influence the decision to sell the uranium to the Russians.

Why do I keep wanting to refer to the Russians as "Soviets?" Old habits die hard.

Dept. of Know Your Enemy: Palestinians Welcome Resounding Trump & Israel Failure at the UN
[BDSMovement] Today, in an emergency session, the overwhelming majority of the world’s nations at the UN General Assembly voted 128-9 in favor of a resolution calling on the United States to overturn its decision to recognize Jerusalem as Israel’s capital.

This "collective act of defiance" took place despite threats from Trump’s ambassador to the UN, Nikki Haley, to "take names" of countries voting against the United States and Israel, and threats by Trump to cut US aid to those countries.

Israel’s ambassador to the UN accused the world body’s members of being "puppets" to the "Palestinian puppet masters", following Israeli Prime Minister Netanyahu’s description of the UN as a "house of lies."

The resounding failure by Israel and the US administration to thwart the pro-Palestinian vote at the UN General Assembly follows a similarly embarrassing UN Security Council vote on Monday which also rejected the US-Israeli position 14-1.

Omar Barghouti, speaking on behalf of the Palestinian BDS National Committee (BNC), the largest coalition in Palestinian civil society, responded by saying:

This vote is further proof that the far-right Israeli-Trump alliance is more isolated than ever as the overwhelming majority of nations are finally recognizing its fatal attempt to undermine both Palestinian rights and the very rule of international law. Holding Israel accountable for its egregious, decades-old human rights violations is crucial to upholding both.

To defend the UN against this thuggery by Israel and the Trump administration, the BDS movement calls for meaningful sanctions, especially a military embargo and intensified boycott and divestment measures against Israel’s regime of oppression. BDS today is not only crucial for realizing Palestinian freedom, justice and equality. It is also critical to stopping Trump, Netanyahu and other leaders of the international far-right who are threatening world peace and global justice like never before.

All European states, with a few exceptions that abstained, voted in favor of the Palestinian position on occupied Jerusalem, and so did Japan, China, India, Nigeria, Brazil, Korea, Russia, and South Africa, among many others.

Favoring concrete sanctions to merely symbolic gestures of solidarity with the Palestinian liberation struggle, South Africa’s ruling African National Congress (ANC) at its general conference yesterday unanimously adopted downgrading diplomatic ties with Israel. "[It] sends a clear message to Israel that there is a price to pay for its human rights abuses and violations of international law," the ANC said in a statement.

The Palestinian BDS National Committee (BNC) is the largest coalition in Palestinian civil society. It leads and supports the global Boycott, Divestment and Sanctions movement for Palestinian rights. Visit our website and follow us on Facebook and Twitter @BDSmovement.

Diyala Clearances Continue

Military operation launched to pursue IS militants between Diyala, Baghdad

Baghdad (Iraqinews.com) – A wide-scale military operation was launched to pursuit Islamic State remnants in the areas between Diyala and Baghdad, a military commander said.

“Joint troops, backed by Iraqi warplanes, have carried out a military operation targeting IS remnants stationed in the areas between Diyala and Baghdad governorates,” Commander of the Tigris Operations Lieutenant General Mezher al-Azzawi told Alghad Press on Tuesday.

“The troops started their mission from Buhriz and Kanaan districts south of Diyala and will continue till the outskirts of Baghdad,” Azzawi said, adding that the operation comes as part of his command’s efforts to reinforce security in these areas.

“The troops will comb all recently-liberated areas between Diyala and Baghdad in search for any IS remnant,” he pointed out.

A similar security campaign was launched on Monday, under the supervision of the Maysan operations command, to apprehend outlaws and drug dealers in the governorate.

The clampdown, which included joint troops from outside the governorate, is also meant to settle tribal disputes, take weapons from citizens and arrest rioters in the governorate.

Islamic State militants killed by paramilitary troops in Hamreen mountains

Diyala (IraqiNews.com) The pro-government paramilitary troops have announced killing Islamic State militants on Tuesday.

“Troops of the 88th of al-Hashd al-Shaabi {Popular Mobilization Forces) destroyed on Tuesday two vehicles loaded with weapons for IS militant in Hamreen mountains,” the media service of the forces said in a statement.

“Troops managed to kill the militants who were on board the vehicles,” the statement added without clarifying the number of militants killed.

Islamic State collected US$500,000 through abduction in Diyala: Official

Diyala (IraqiNews.com) Islamic State has obtained around US$500,000 through abduction operations in Diyala in 2017, a paramilitary official was quoted saying on Tuesday.

Speaking to AlSumaria News, Jabbar al-Maamouri, leader with al-Hashd al-Shaabi (Popular Mobilization Forces) said “IS militants launched a series of attacks at some regions in Diyala in 2017 through its sleeper cells in Hamreen, Qurret Tabbah and Neft Khana. The group obtained amounts of money that reach up to around US$500,000, in accordance to information we have.”

“The abduction has turned to an internal source of funding for the group, which collected the money to reinforce its sleeper cells. This indicates the activity in some regions including Hamreen, which are encountered by security troops,” Maamouri added.

The abduction processes, according to Maamouri, usually occur without the relatives of the kidnapped file reports against the kidnappers. “They pay huge amounts of money, which is wrong as this would support terrorism and encourages more abduction.”

Tunisia working with UAE on terrorist threat from female Islamist militant returnees
[AlAhram] The UAE, which angered Tunisia by banning Tunisian women from its passenger flights, has intelligence that female Islamist myrmidon returning from Iraq or Syria might try to use Tunisian passports to stage terrorist attacks, a Tunisian government official said.

Tunisia had demanded the United Arab Emirates apologise for the travel ban - saying that the UAE had provided no explanation - and on Sunday it suspended the Dubai-based airline Emirates from operating at Tunis airport.

Since then, Saida Garrach, an advisor at the Tunisian presidency, told local radio Shems FM that the UAE had "serious information over the possibility of terrorist acts as part of returning fighters leaving Iraq and Syria," and that the two countries were now working together to address the threat.

"There are terrorist plots in several countries," Garrach said in an interview conducted on Monday and posted on the station's website.

"What concerns the United Arab Emirates is the possibility of terrorist acts committed by Tunisian women or by Tunisian passport holders," she said.

Garrach criticised the way the threat had been communicated to Tunisia.

"We are fighting terrorism together with the United Arab Emirates and we are coordinating to solve this problem. But we cannot accept the way Tunisian women are treated and don't accept what has happened to Tunisian women at airports."

Tunisia is among the countries with the highest per capita number of myrmidon Islamists, a problem linked to widespread radicalisation among disillusioned youths and a loosening of security controls after Tunisia’s 2011 uprising.

Abu Sayyaf attack injures five in Sulu
[PhilStar] Suspected Abu Sayyaf rebels fired at an army base in Patikul, Sulu on Sunday evening, leaving four soldiers and a civilian injured.

Soldiers of the Bravo Company of the 32nd Infantry Battalion were preparing for a Christmas party when they were attacked, Brig. Gen. Cirilito Sobejana, Joint Task Force Sulu commander, said. He said around 20 bandits fired rifle grenades, triggering around 25 minutes of heavy fighting.

Sobejana said troops launched mortar attacks on Abu Sayyaf positions. He said the Abu Sayyaf also suffered casualties, citing blood stains along the escape route of the militants.

Meanwhile, in Zamboanga City, an Abu Sayyaf rebel wanted for kidnapping was arrested on Sunday morning. Baser Ahmad, with aliases of Abu Pandak Duma and Bensar, was nabbed at his safehouse in Sitio Talungon, Barangay San Roque by police operatives and the Naval Intelligence Service Group.

Islamic State claims responsibility for attack killing security personnel in Kirkuk

Kirkuk (IraqiNews.com) Islamic State has claimed responsibility for the attack that targeted security personnel and a senior tribesman earlier this week.

A report issued by the militant group’s media arm Amaq agency on Monday said that eight Iraqi security personnel, including six officers and two colonels were killed in an operation by the militants on Riyad-Hawija road.

Another statement by the group’s so-called Kirkuk State Media Center said militants targeted several personnel of al-Hashd al-Shaabi (Popular Mobilization Forces) killing eight of them, including six officers.

On Sunday, Kirkuk police said the militants carried out an attack against security troops in al-Rubeida village, south of the province. The attack killed each of Col. Fadel al-Sabaawi, police department chief, his son, a Federal Police personnel, Cap. Ali Ahmed, Maher Ali and Saeed Ahmed, from Tribal Mobilization Forces, and Walid Nuri head of al-Geheish tribe.

Three army personnel killed, injured in bomb attack in Hawija

Kirkuk (Iraqinews.com) – Three army personnel were killed and injured Tuesday in a bomb blast in Hawija town in Kirkuk, a security source was quoted saying.

“An explosive charge went off while an army patrol was passing by al-Safra district in Hawija, leaving two soldiers dead and an officer injured,” the source told Baghdad Today.

Official: IS militants killed 45 civilians, security men in Hawija in two months

Kirkuk (Iraqinews.com) – At least 45 civilians and security personnel were killed in attacks launched by Islamic State militants on Hawija city, Kirkuk, over the past two months, a senior security official said on Tuesday.

“The Iraqi army and police, on the other hand, killed 288 Jihadists and arrested 55 others during the same period,” Middle East Online quoted the official as saying.

Meanwhile, a security expert warned that, “Islamic State militants are still hiding in tunnels at agricultural areas on the outskirts of Hawija.”

“Such IS cells are posing a major threat to the entire region,” expert Sarmad Al-Bayati said, charging IS militants with kidnapping and murdering civilians to prevent the displaced people from returning to their home regions.

Another well-placed officer in the Iraqi Army said that the military operation to liberate Hawija has just focused on the main roads and districts of the city, pointing out that after the recapture of the city from Islamic State, some Jihadists surrendered to the Iraqi troops, while others fled to Hamrin Mountains and surrounding areas.

“The fleeing Jihadists have already killed many relatives of Iraqi soldiers over the past period,” the officer said.

OPTIMISM: Mastercard Sez Christmas Spending Was Historical
... and this was only year 1 of 8 years of Trump-onomics ...
[Yahoo] Shares of U.S. department stores jumped on Tuesday as Mastercard Inc said shoppers spent over $800 billion during the season, more than ever before, boosted by growing consumer confidence, rising employment and early discounts.

Sarah Quinlan, head of market insights for Mastercard Advisors, disclosed the figure after the payments processor's analytics arm published its SpendingPulse retail report.

The report said holiday sales in stores and online between Nov 1 and Dec 24 rose 4.9 percent, the fastest year-on-year pace of increase since 2011. Mastercard, which tracks spending by combining sales activity in its payments network with estimates of cash and other payment forms, excluded automobile sales from its figures.

Most U.S. retail stocks have tumbled this year as they continued to lose sales to online stores, mainly Amazon.com Inc. Traditional players have also been hurt by heavy investments in technology and discounting, made to keep up with online and off-price competition.

Shares in J.C. Penney Co Inc rose 7.6 percent on Tuesday, while Kohl's Corp shares were up 5.8 percent, Macy's Inc rose 5.1 percent and Nordstrom Inc increased 2.8 percent.

SpendingPulse said the moderate sales increases seen in apparel and department stores were particularly impressive given this year's slew of store closures.

Online sales rose 18.1 percent during the holiday season, thanks to a late rally in sales, according to Mastercard.

"But that's probably only 11 or 12 percent of total retail sales ... the bulk of sales still is very much in stores," said Quinlan.

"There's growth, don't get me wrong, but we still love that experience of being in store."

The biggest winner of the holiday season was likely to be Amazon.com once again, however, according to a Reuters/Ipsos opinion poll conducted this month.

Amazon.com said on Tuesday that it had topped its worldwide holiday sales record this year, with more than 4 million people opting to trial Amazon Prime in one week during the period.

Trump’s decision on al-Quds aimed at killing Palestinian cause: Hamas chief
[PRESSTV] The politburo chief of the Paleostinian Islamic resistance movement, Hamas, always the voice of sweet reason,, has censured US President Donald Trump
...New York real estate developer, described by Dems as illiterate, racist, misogynistic, and what ever other unpleasant descriptions they can think of, elected by the rest of us as 45th President of the United States...
’s recognition of Jerusalem al-Quds as Israel’s capital, describing the measure as an attempt by the White House to abolish the Paleostinian cause.

"The recent US decision on al-Quds is part of ongoing efforts to terminate the Paleostinian cause within the context of a so-called ’deal of the century’," Ismail Haniyeh
...became Prime Minister after the legislative elections of 2006 which Hamas won. President Mahmoud Abbas dismissed Haniyeh from office on 14 June 2007 at the height of the Fatah-Hamas festivities, but Haniyeh did not acknowledge the decree and continues as the PM of Gazoo while Abbas maintains a separate PM in the West Bank...
said at a meeting with Paleostinian tribal leaders in Gazoo City on Tuesday.

He added that the controversial US move "has implications for the reconfiguration of the entire region ... which will come at the expense of al-Quds and Paleostinian rights."

Haniyeh further noted that Hamas had obtained information concerning a US plan to offer Paleostinian leaders a state with its capital in Abu Dis village, which lies on the border with Jerusalem al-Quds.

"The plan involves building a bridge linking Abu Dis to the al-Aqsa Mosque compound [in East Jerusalem al-Quds] with the ostensible aim of ensuring [Paleostinians] access to the mosque," the Hamas leader asserted.

Haniyeh added, "There is also a talk of dividing the al-Aqsa Mosque compound into three separate parts."

The Hamas chief also criticized some regional Arab states for normalizing diplomatic ties with Israel at the expense of Paleostinian people.

Haniyeh then slammed the Tel Aviv regime for its settlement expansion activities in the occupied Paleostinian territories.

On December 6, Trump announced his decision to recognize Jerusalem al-Quds as Israel’s capital and relocate the US embassy in Israel from Tel Aviv to Jerusalem al-Quds.

Egyptian military provides security alongside police during Christmas celebrations
[AlAhram] Egyptian military personnel have been deployed on Tuesday to assist police in protecting public institutions and facilities as well as places of worship and major traffic ways in several governorates during Christmas celebrations.

Security patrols, military police personnel, and rapid deployment forces have been stationed in vital areas and at joint checkpoints with police forces.

Egyptian Christian churches have been repeatedly targeted by terrorist attacks in recent years.

Coptic Orthodox Egyptians, who make up 90 percent of all Christians in the country, celebrate Christmas on 7 January, though a minority of Christians observe the holiday on 25 December.

Christians make up about 10 to 15 percent of Egypt’s 90 million people.

Swede among 'terror' suspects arrested in the Netherlands
[TheLocal.se] Dutch police have locked away
Please don't kill me!
four men including a Swedish citizen suspected of being involved in terror-related activities, prosecutors said on Tuesday.

"Rotterdam police detained four men early on Sunday evening on suspicion of being involved in terrorism," the public prosecution's office said in a statement.

One of the men, aged 29, arrived on a flight from Stockholm earlier on Sunday while the other three aged 21, 23 and 30 come from the cities of Vlaardingen, Delft and Gouda in southwest Netherlands.

Dutch police raided three homes in the three cities and seized data but found no weapons or explosives, the statement said.

Although "there is no concrete information to indicate a terror attack, police and the public prosecution's office are not taking any chances," prosecutors said without giving further information.

The suspects remain in jug pending a court appearance.

A Dutch citizen was sentenced to four years in November for preparing a terror attack following his arrest in Rotterdam last year, when police discovered an assault rifle and a large amount of fireworks.

In another scare, Dutch military police shot and maimed a man armed with a knife at Amsterdam's Schiphol airport earlier this month, but authorities said the incident was not terror-related.

The Netherlands has so far been spared from the slew of terror attacks to have rocked its closest European neighbours in recent years.
They haven’t had a major attack by a well-rehearsed team of jihadis armed with bombs and guns, nor a shopping street terrorized by a lone wolf knifing everyone in sight or driving a truck through the crowd. But given that Pim Fortuyn was assassinated in 2002 for advocating closing the borders of the Netherlands to Muslim colonists, Theo van Gogh was assassinated in 2004 for producing Ayaan Hirsi Ali’s Submission, and Ms Ali and Geert Wilders will have to live the rest of their lives with armed guards against a similar fate, it’s a bit simplistic of the Dutch to claim they do not have a jihadi problem.

The report did not name those involved in what appeared to be the first large-scale release since the royals, business people and government officials were detained in a crackdown spearheaded by Crown Prince Mohammed bin Salman.

The suspects have been held at Riyadh's luxurious Ritz Carlton hotel since early November and told to hand over assets and cash in exchange for their freedom.

Okaz said more detainees would be released in the coming days and trial proceedings would begin soon for those who continue to deny the charges against them.

Saudi authorities see the settlements not as blackmail but as an obligation to reimburse money taken illegally from the world's top oil producer over several decades.

Syrian refugees in Lebanon drop below one million: UN
[IsraelTimes] The number of registered Syrian refugees in Leb has dropped to below one million for the first time since 2014, the United Nations
...an organization originally established to war on dictatorships which was promptly infiltrated by dictatorships and is now held in thrall to dictatorships...
tells AFP.

As of the end of November, the UN refugee agency (UNHCR) counted 997,905 Syrian refugees ‐ a vast majority of them women and kiddies ‐ registered in Leb.

"The number reached one million in April 2014, and this is the first time it drops below that," UNHCR spokeswoman Lisa Abou Khaled says.

Numbers were decreasing, Abou Khaled said, as refugees had resettled in third countries, returned to their homes in Syria, or passed away.

From 2011 until September this year, nearly 49,000 Syrians left Leb as part of the United Nations’ resettlement program to third countries including the United States, Sweden, and La Belle France.

North Korea soldier who defected had immunity to anthrax
Wow. That's weird. How or why would he have acquired that immunity? Ima stumped
[NYPost] A North Korean soldier who defected to the South was found to have antibodies to anthrax ‐ triggering concerns that the rogue regime has weaponized the deadly bacteria, according to reports Tuesday.

The man, who was either exposed to or vaccinated for anthrax, had developed immunity to the deadly disease before defecting, UPI reported, citing local Channel A.

A South Korean intelligence official who spoke on condition of anonymity did not say which of the four soldiers who fled the hermit kingdom this year had the antibodies in his system.

The discovery is causing concern in Seoul because the disease can kill at least 80 percent of those who are exposed to the bacterium in 24 hours ‐ unless antibiotics are taken or vaccination is available.

But South Korea's military has yet to procure an anthrax vaccine.

Defense Ministry spokeswoman Choi Hyun-soo has said an anthrax "vaccine is expected to be developed by the end of 2019," but not sooner, UPI reported.

The North Korean rogue regime has been suspected of developing biological weapons after in 2015 publicizing the works of the Pyongyang Biological Technology Research Institute, which is run by the Korean People's Army Unit 810.

for receiving a bribe from a detainee in Baghdad Tuesday.

In a statement, a copy of which was obtained by Alghad Press, the Baghdad Operations Command said, "The troops have found a rocket and dismantled several bombs and a booby-trapped house at Tel Tasah and al-Shortan areas north of the Iraqi capital."

No casualties were reported, the statement read.

Meanwhile,

According to Baghdad Today, the officer was apprehended while taking a $1,000 bribe from a prisoner in return for releasing him.

Kurdish government accepts Baghdad’s conditions to end dispute
[ARABNEWS] The Iraqi Kurdistan Regional Government (KRG) has agreed on the conditions stipulated by Baghdad’s federal government to solve outstanding problems between the two governments.

Talks will be resumed to end the punitive measures in the Kurdish region, Iraqi Prime Minister Haider Abadi said on Tuesday.

The KRG held a controversial referendum on independence in late September inside the region and disputed areas seized by the Kurdish forces during the past years.

Baghdad responded by imposing a series of punitive measures on the region including banning international flights into and from the region’s airports, shutting down the border crossings between the region, The Sick Man of Europe Turkey
...the only place on the face of the earth that misses the Ottoman Empire....
and Iran, and launching a huge military campaign to drive the Kurdish forces back to the 2005 constitutionally approved border.

Considering the September referendum illegal, Baghdad took steps to reinforce federal writ in and around the region, which has been autonomous since 2003. Abadi said there is a dispute between Baghdad and the KRG over the border of the region and the running of the border of the country.

"The constitution was clear relating to the border of the region and it was recognized (by the constitution) as the border of the region on March 9, 2001, but the regional (Kurdish) forces were out of these borders," Abadi said on Tuesday in his weekly presser.

"Also, the border (of the country) should be exclusively under the control of the federal government... so we took several measures to control the border and the border crossings.

"Now the regional government and the (Kurdish) officials said that they agree on these two points (conditions) and let’s talk," Abadi said.

"I consider this an essential change... but we want to reiterate two things ‐ which are the referendum was illegal and (there will be) no return to it (the results) again. The second thing is the recognition of the 2003 borders of the region and the borders (of the country) should be under the control of the central government."

Blocked from Europe, migrants settle in Morocco
[ARABNEWS] Unable to reach Europe
...also known as Moslem Lebensraum...
in search of a better life, Aliou Ndiaye settled in Morocco instead, giving up on his original goal like thousands of other sub-Saharan African migrants colonists.

"Everyone has the right to go to another country to try their luck," the 31-year-old former fish exporter from Senegal
... a nation of about 14 million on the west coast of Africa bordering Mauretania to the north, Mali to the east, and a pair of Guineas to the south, one of them Bissau. It is 90 percent Mohammedan and has more than 80 political parties. Its primary purpose seems to be absorbing refugees...
told AFP.

"Lots of people are trying to reach Europe, but some end up staying to make a living."

Seven out of 10 West Africa-born migrants colonists stay on the continent, according to a December study by the Moroccan think tank OCP Policy Center.

Discouraged by the danger of passing through countries such as Libya and by harsh policies aimed at preventing migrants colonists going to Europe, many settle in "transit" countries including Morocco.

Ndiaye said he gave up after he realized reaching Spain was "too hard."

He took on several informal jobs and finally set himself up as a street vendor in Rabat, where he expects to remain.

His story illustrates a trend that has gained increasing attention from Moroccan politicians, civil society and researchers.

Morocco has turned from a transit country into a host country for immigrants colonists, according to the government’s High Commission for Planning.

"The Moroccan authorities have switched from a security approach, which criminalized illegal immigration, to a discourse of integration," said Mehdi Alioua, former head of a group that helped migrants colonists.

FBI fingerprint software could be bugged by Russians: Sources
[PRESSTV] The software the FBI and 18,000 other US law enforcement agencies use to analyze fingerprints may contain a Russian code placed by a French company after a secret deal with a Russian firm, two whistleblowers say.

The former employees of a subsidiary of the French firm Safran Group said the company secretly purchased code from the Russian cybersecurity company Papillon Systems and then included it in fingerprint analysis software it later sold to the FBI, BuzzFeed News reported Tuesday.

The Russian company is said to be regularly working with Russian law enforcement agencies such as the Federal Security Service

(FSB).

According to Philippe Desbois, the Safran subsidiary's former CEO of Russia operations, officials in Safran Group have been worried that the FBI may learn the truth.

province of Afghanistan which resulted into the destruction of the mosque building.

The provincial government media office in a statement said the incident took place in the early hours of Tuesday morning in Momand Dara district after several landmines stored inside the mosque by the snuffies went off.

The statement further added that the kaboom also caused damage to the nearby buildings besides causing heavy loss to the building of the mosque.

According to the Nangarhar government, several religious books and materials, including the holdy Koran copies also sustained damages in the kaboom.

This comes as the anti-government armed snuffies had earlier detonated explosives inside a mosque in Momand Dara which resulted into the killing of a prayer leader of the mosque besides injuring eight others.

The provincial governor Mohammad Gulab Mangal strongly condemned today’s incident and called it an unforgivable crime.

Gunmen kill 10 villagers in northern Nigeria: Officials
[AlAhram] Gunmen have killed 10 people in attacks on two Christian-dominated villages in the northern Nigerian state of Kaduna, a hotbed of ethnic and religous strife, officials said Tuesday.

On Christmas Eve, six people were killed when button men suspected to be ethnic Fulani Moslems stormed Ungwan Mailafiya, they said.

The killings followed an attack in nearby Nindem late Friday where button men opened fire on a congregation, killing four and injuring 10, said a local politician.

"While we were mourning the deaths at Nindem ... the security personnel received distress calls of another attack at Ungwan Mailafiya", parliamentarian Shehu Nicholas Garba said in a statement.

"By daybreak on Christmas, six persons had been confirmed killed, including a child of about six years old, and many others injured," he said.

A front man from the state government said troops had been deployed to prevent further violence.

Southern Kaduna has for three decades been locked in tit-for-tat killings between indigenous Christian farming communities and Moslem Hausa and Fulani settlers.

The dispute was originally over land and grazing rights but has lately degenerated into ethnic and religious conflicts, leaving hundreds dead.

Syrian 'opposition' dismisses initiative to hold congress in Sochi
[PRESSTV] Forty Syrian "opposition" groups have rejected a Russian initiative for holding a congress with the participation of Syria’s conflicting sides in the Black Sea resort of Sochi next month.

In a joint statement on Monday, the so-called Syrian opposition faction which also includes Ahrar al-Sham
...a Syria jihadi group made up of Islamists and salafists, not that there's that much difference, formed into a brigade. They make up the main element of the Islamic Front but they don't profess adoration of al-Qaeda and they've been fighting (mainly for survival) against the Islamic State. Their leadership was wiped out at a single blow by a suicide kaboom at a crowded basement meeting in September, 2014...
and US-backed Mutasem Brigades, said the congress is aimed at undermining a parallel UN-backed Syrian peace talks in Geneva.

"We completely reject Russia's attempt to circumvent the Geneva track," the statement said.

"We call on all forces to stand in one rank against these alarming dangers," the opposition faction noted.

On Friday, Russia and Iran, both allies of the Syrian government, agreed with opposition-backer The Sick Man of Europe Turkey
...the only place on the face of the earth that misses the Ottoman Empire....
to hold a "Congress of National Dialogue" in Sochi on January 29 and 30.

Syria's government immediately announced that it would attend the event.

Syrian Kurdish and Christian parties voiced support for the Sochi initiative on Tuesday, calling it their "right" to attend the congress.

(JeM) group, and his comrades were rubbed out outside the main city of Srinagar on Monday evening.

Indian troops cordoned off a group of houses in Samboora, "which resulted in a fierce shootout leading to elimination of top JeM commander Noor Mohammad Tantray," the statement said.

Police described the operation as a "significant breakthrough" after Tantray's body was found under debris on Tuesday.

The 47-year-old JeM commander was described by officials as a new "security headache" when he took over as the head of the group.

According to police, Tantray spent 12 years in jail after being convicted in a case of militancy in 2003, but jumped parole two years later to rejoin JeM.

As the news of Tantray's death spread, hundreds of Kashmiri people rushed to the scene, chanting anti-India slogans and hurling stones at the troops.

Security forces used tear gas and pellet guns to disperse angry protesters. At least six protesters were maimed.

Somali Army Repels Al-Shabab After Attack On Military Base
[RADIOSHABELLE] Somali government forces repulsed Al-Shabaab
... the personification of Somali state failure...
after an attack on a military base in Afgoye town located some 30Km south of the somali capital, Mogadishu on Monday night.

The military remained in control of a town following a fierce shootout with al-Qaeda-linked al-Shabaab myrmidons, according to locals.

Military officials said Al-Shabaab fighters stormed the military base there but were later driven out by the army after heavy fighting.

"We were awoken by an ambush attack by Al-Shabaab and a then fierce battle followed," resident Mohammed Abdullahi told Radio Shabelle from the town.

He added that Afgoye is calm and government forces fully control.

Al-Shabaab, however, claimed it had killed several soldiers in the fighting and left the town after seizing military equipment and weapons.

The development came as Somali government says is planning an offensive aimed at flushing out Al-Shabaab from its remaining pockets in the south and central Somalia.

Maoist militants ready to face 'full-scale war' in Mindanao
[Inquirer] Communist militants in southern Mindanao said they were ready to face “the full-scale war” that the Duterte administration would be unleashing on them next year.

In a statement issued for the founding anniversary of the Communist Party of the Philippines on Tuesday, Ka Joaquin Jacinto, the National Democratic Front spokesperson in the region, also said the New People’s Army would continue to exist to oppose the government’s abuses. He said, "Despite the use of airstrikes, armed drones and prolonged focus operations, not one single NPA unit in Mindanao was wiped out. The number of platoons and companies has in fact increased this year."

Jacinto said NPA rebels were “ever willing to sacrifice their lives for the revolution and the people than be servile to the fascist dictatorship of the US-Duterte regime.”

“In spite of the constant black propaganda, bogus peace caravans and the incessant parade of fake or recycled surrenderees, NPA Red commanders and fighters never faltered,” he added.

He said 2017 was a triumphant year for the NPA in southern Mindanao, where it launched more than 300 attacks. He said, "There were a few well-chosen and well-executed head blows as wells as numerous attritive actions against operating enemy troops, military camps and police outposts, making them suffer a casualty rate of more than a battalion."

“The NPA must be determined to bring the people’s war to new heights,” he added.

GOP Rep Rooney Suggests a ‘Purge' at ‘Off the Rails' FBI, DOJ
[Breitbart] Tuesday on MSNBC, Rep. Francis Rooney (R-FL) described the FBI and the Department of Justice as "off the rails" and suggested the possibility of a "purge" at the FBI and the Department of Justice.

Partial transcript as follows:

JACKSON: Before I let you go, I need to ask you about the president and his tweets. He’s been fairly quiet Christmas day, but the president is tweeting about the FBI. He’s been tweeting about his Deputy Director Andrew McCabe, why is that the right message right now for Donald Trump and Republicans?

ROONEY: Well, there’s two issues here. Yes, the president does have his own unique communication style, which I don’t think any of us have seen the use of Twitter deployed so broadly as a president does. But on the investigation, that investigation is totally off the rails. And I am really concerned ‐

JACKSON: But he’s not tweeting about the investigation. He is tweeting about the deputy director. He’s tweeting about FBI agents. Congressman, do you think that is appropriate for the president?

ROONEY: I’m very concerned that the DOJ and the FBI, whether you want to call it deep state or what, are kinda off the rails. When you look at what the Strzok guy was texting, you look at that Ohr guy talking to the dossier Clinton op research people, and the McCabe guy’s wife takes $600,000 from Clinton-related sources while running for state senator.

"While you're practicing, the MantisX is analyzing the movements of your gun before, during and after each shot," the commercial states. "It highlights and helps you avoid errors, like pulling, heeling, anticipating recoil, breaking your wrist up or down, or tightening grip while pulling the trigger."

The wireless device, which provides real-time feedback, is designed for live fire on the range, dry fire, and airsoft, CO2 and other types of pistols, according to the video. The product doesn't require a special target and works at any distance.

[AA.TR] Police in Istanbul have tossed in the slammer

a total of 714 ISIS suspects during counter-terrorism operations from Sep. 1 to Dec. 26, according to security officials.

Istanbul anti-terror police department have conducted over 20 operations across the province to prevent any possible terror incident.

Among the suspects, 670 were foreigners, according to security officials, who asked not to be named due to restrictions on speaking to the media.

During the same period, a number of planned kabooms have been thwarted, they said.

In December, four separate operations across the province saw arrests of more than 100 ISIS suspects.

On Nov. 11, an Istanbul court remanded into custody a group of six people, who were allegedly planning terror attacks on the instructions of ISIS in Syria and Iraq.

On Oct. 28, four ISIS suspects, including two females, were arrested as they attempted to bomb a parking area in a shopping mall in Bayrampasa district of the province.

In another operation on Sep. 10, at least 25 suspects, including three senior ISIS figures, were captured. They were produced before the local court, which remanded them in jug for being members of an armed terrorist organization.

During the operations, many organizational documents were seized in addition to the explosives and guns.

US sanctions two North Koreans over missile program
[IsraelTimes] The United States today sanctioned two senior North Korean officials over the country’s ballistic missile program, the Treasury Department says.

"Treasury is targeting leaders of North Korea’s ballistic missile programs, as part of our maximum pressure campaign to isolate (North Korea) and achieve a fully denuclearized Korean Peninsula," it says in a statement.
Update from An Nahar at :20p.m. ET names names:
The U.S. Treasury Department issued sanctions Tuesday against two officials it describes as "key leaders of North Korea's unlawful weapons programs."

The sanctions against Kim Jong Sik and Ri Pyong Chol block them from any property or interests in property within U.S. jurisdiction, and prohibit them from transactions with American citizens. Treasury said the men are senior officials in North Korea's Munitions Industry Department.

Treasury Secretary Steven Mnuchin said the sanctions are part of the United States' "maximum pressure campaign" to isolate North Korea and "achieve a fully denuclearized Korean Peninsula."

The United Nations Security Council unanimously approved tough new sanctions against North Korea on Friday in response to its latest launch of a ballistic missile, which Pyongyang says is capable of reaching the U.S. mainland.

Baik Tae-hyun, spokesman of South Korea's Unification Ministry noted it was the seventh time the U.S. Treasury has imposed unilateral sanctions against the North since the start of President Donald Trump's administration. Baik also pointed out that the two North Koreans had already been under U.N. Security Council sanctions.

Egypt executes 15 for deadly terrorist attack in 2013: Defence lawyer
[AlAhram] Egyptian authorities executed 15 people on Tuesday who had been convicted in a terrorism-related case dating back to 2013, Khaled al-Masry, a defence lawyer in the case said.

The 15 men were convicted of the murder of military personnel during a holy warrior attack in Arish, North Sinai, on 15 August 2013. The assault on a checkpoint left one army officer and eight soldiers dead.

A military court issued a preliminary death sentence against the defendants in 2015.

In November of this year, the High Military Cassation Court rejected an appeal against the sentence, and the 15 men were issued with final verdicts.

Here is the report we had at the time from An Nahar, under the headline At Least 578 People Killed in Egypt Festivities:
A 21-year-old policeman was fatally shot in the chest and arm in the North Sinai town of Al-Arish after gunnies attacked the Police Club.

Later in the Sinai peninsula, snuffies killed seven other soldiers in an attack on a checkpoint, security officials said.

The soldiers were killed when gunnies in two cars attacked them in their tents at a checkpoint near a cop shoppe in the town of El-Arish, the officials said.

The northern part of the peninsula has seen a semi-insurgency by Bedouin snuffies since the July 3 military overthrow of Mohammed Morsi.

An Nahar adds:
IS's Egypt affiliate has killed hundreds of coppers and soldiers in attacks in the Sinai and also targeted civilians in the mainland.

Egyptian courts have sentenced hundreds to death over unrest since the military ousted divisive
...politicians call things divisive when when the other side sez something they don't like. Their own statements are never divisive, they're principled...
Islamist president Mohammed Morsi in 2013. But most defendants have appealed and won retrials.

While their attacks have become less frequent, they have increasingly targeted civilians over the past year.

In November, suspected IS button men massacred more than 300 Moslem worshippers at a mosque in Sinai associated with Sufi Moslems IS views as heretical.

The jihadists have killed more than 100 Christians in church bombings and shootings since December last year.

After the mosque massacre, President Abdel Fattah al-Sissi instructed his military chief of staff to quell the attacks in three months using "brutal force".

Judge: American accused of fighting for IS must get lawyer
More on this story from a few days ago.
[FoxNews] A federal judge ruled Saturday that the U.S. military must provide legal counsel to an American citizen who was picked up months ago on the Syrian battlefield and accused of fighting with Islamic State militants.

The unidentified American, who has not been charged, surrendered to U.S.-backed fighters in Syria around Sept. 12 and is currently being held in Iraq as an unlawful enemy combatant.

The American Civil Liberties Union filed a court petition challenging his detention and asking to act on his behalf to provide him access to legal counsel.

Late last month, the U.S. government acknowledged that it has detained an American citizen accused of fighting with IS for months without fulfilling his request to see a lawyer. Responding to a court order, the government said the man picked up on the Syrian battlefield indicated he was willing to talk to FBI agents but "felt he should have an attorney present."

In her ruling, U.S. District Judge Tanya Chutkan denied the Defense Department's motion to dismiss the matter and ordered the military to let the ACLU "immediate and unmonitored access to the detainee" so that it can determine whether he wants the ACLU to represent him. The judge also ordered the Defense Department not to transfer the detainee until the ACLU tells the court of the detainee's wishes.

"This is a landmark ruling that rejects the Trump administration's unprecedented attempt to block an American citizen from challenging his executive imprisonment," said Jonathan Hafetz, senior staff attorney for the ACLU. "Ensuring citizens detained by the government have access to a lawyer and a court is essential to preserving the Constitution and the rule of law in America."

Kathryn Wyer, an attorney in the Justice Department's civil division, earlier told the court that the U.S. military was working "diligently" on the matter, but had not yet decided what to do with the detainee. Wyer cited case law stating the executive branch should be given a reasonable period of time to determine a detained individual's status.

The government said that during questioning that FBI special agents advised the detainee of his right to remain silent even though he might have spoken earlier to other interrogators. That was an apparent reference to intelligence agents who are believed to have questioned the detainee first. The government said the detainee also was advised of his right to an attorney.

But the government also acknowledged that the detainee said he "understood his rights and said he was willing to talk to the agents, but also stated that since he was in a new phase (of questioning), he felt he should have an attorney present."
Maybe the U.S. military can "work diligently" in assisting the local authorities in coming up with a local version of writ of habeas corpus?

Sorry Judgee, there is no legal authority at play here. It's outside American jurisdiction on foreign territory (see - imperialism and extra-territoriality). For grins and as an example to others, turn him over to the Iraqis as an unlawful combatant to be handled accordingly.

Trump’s first year in office is complete failure: Analyst
Bless their hearts...
[PRESSTV] US President Donald Trump
...New York real estate developer, described by Dems as illiterate, racist, misogynistic, and what ever other unpleasant descriptions they can think of, elected by the rest of us as 45th President of the United States...
’s first year in the White House has been a complete failure, according to Myles Hoenig, an American political analyst and activist.

Hoenig, a former Green Party candidate for Congress, made the remarks in an interview with Press TV on Tuesday when asked what Trump has achieved in 2017, and whether he has delivered on his campaign promises.

"With President Trump, we really got a president like no other. No one expected the erudition of a JFK or the appearance of the ’coolness’ of a Barack Obama
teachable moment...
, but did we really expect a cross between Berlusconi of Italia and the cartoon character Peter Griffin of Family Guy?" Hoenig said.

"By nearly all measures, Trump is a failure his first year. Except for his signature welfare for the uber-wealthy tax reform bill, he has no legislative history to date. Much of what he has accomplished has been through presidential fiat, his executive orders," he added.

"He has proven himself to be a lot less than what his publicists (and he) have been proclaiming for decades. The fantastic deal maker failed in nearly every legislative venture he attempted, until the welfare bill for his Mar a Lago patrons," the analyst said.

"He failed at repealing Obamacare
... aka the Affordable Care Act, an ineptly designed and worse executed piece of legislation designed to bring 17 percent of the U.S. economy under the direct control of the government. The previous iteration, known as Hillarycare, was laughed out of Washington. This stinker was passed on a party-line vote without being read...
, building a wall and having Mexico pay for it, or improving the economy, except that those with the economic power believe the economy is doing well. He was successful in doing all things negative that he promised. The US no longer abides by the Gay Paree Agreements, he’s terminating US’s agreement with Iran on the nuclear deal and he’s imposed travel bans to the US on Moslems, specifically targeting them," the activist noted.

"What Trump will most be remembered for the first year is his boorish behavior, his intellectual witlessness and promotion of hate. Trump’s idiotic tweets reflect his thinking at the moment, which sometimes had changed to something even more idiotic or contradictory," he continued.

Nigerian Army Thwarts Boko Haram Attack on Maiduguri
Considerably more on this story from yesterday.
[AnNahar] Boko Haram
... not to be confused with Procol Harum, Harum Scarum, possibly to be confused with Helter Skelter. The Nigerian version of al-Qaeda and the Taliban rolled together and flavored with a smigeon of distinctly Subsaharan ignorance and brutality...
jihadists made a failed Christmas Day attempt to attack Nigeria's major northeast city of Maiduguri as they were pushed out by Nigerian soldiers after a prolonged shootout, military and militia sources told AFP.

The jihadists in "several" pickup trucks opened fire on a military checkpoint on the Molai outskirts of the city at around 5:30 pm (1630 GMT) on Monday, triggering a gun fight that lasted for more than an hour.

"The snuffies came in several pickups and engaged troops at Molai who fought and repelled the attack with aerial support," said a senior military officer in Maiduguri.

"It was clear they wanted to overrun the checkpoint and enter the city to cause mayhem," said the military officer who requested anonymity.

The button men used the cover of a convoy of civilian vehicles under military escort returning from the town of Damboa, 90 kilometres away, to launch the attack, said Ibrahim Liman, a militia leader assisting the Nigerian army in fighting the Islamists.

"One of the Boko Haram vehicles infiltrated the middle section of a civilian convoy...and engaged soldiers," Liman said.

Boko Haram reinforcements lurking in the nearby Cashew Plantation and Jiddari Polo areas joined in the battle, Liman added.

The fighting prompted Molai residents to flee into Maiduguri and the influx caused panic among residents.

Troop reinforcements from the city were deployed to Molar and helped in repelling the attack, the military source said.

It was not possible to immediately establish the number of casualties as the scene of the fighting was cordoned off by troops after the button men were pushed out at 7:20 pm (1820 GMT), Liman said.

Security had been tightened in Maiduguri for the Christmas weekend in anticipation of possible Boko Haram attacks. Police issued a statement asking residents to be vigilant and report suspicious persons and abandoned objects to security personnel.

Earlier Monday, troops in nearby Yobe state bumped off 10 jihadists who tried to attack a military post on a highway linking the two states, according to militia leader Mustapha Karimbe.

"Soldiers killed 10 of the snuffies and recovered four pickups while the rest fled," Karimbe said.

Boko Haram's eight-year insurgency has killed 20,000 people and displaced 2.6 million more in Nigeria. In recent months attacks on military and civilian targets as well as raids on remote villages in the northeast have increased.

The surge in attacks has been attributed to Boko Haram's desperate search for much-needed weapons and food supplies following military offensives which cut off the myrmidons' supply routes.

Multiple attacks in southern Thailand overnight
[Bangkok Post] Several checkpoints in Narathiwat province were attacked by gunmen, a microwave tower set on fire and roads blocked by trees and burning tires on Monday night.

One checkpoint was attacked while police were searching halted vehicles. Shots were also fired at a military checkpoint. Another group armed with assault rifles exchanged shots for 20-minutes with a military patrol, and two M-79 grenades were fired at an army watch tower, but missed the target.

The attackers scattered nail spikes on the road 400 meters from the checkpoint before escaping. A blue tupperware container loaded with firecrackers was also exploded, probably as a decoy while they made their escape.

In Sungai Padi district, car tires were piled under a Dtac microwave tower and set ablaze. The tower was destroyed. Roads linking Sungai Kolok and Sungai Padi were also blocked by burning tires and chopped-down trees.

Sheryl Attkisson: 10 times the intel community violated the trust of the American citizen
[The Hill] No matter where you stand politically, a growing body of facts raises the question: Is there systemic corruption or misfeasance at work inside America’s intelligence agencies?

By that, I don’t mean people stealing money. I mean officials who are stealing our privacy ‐ using the tools of intelligence-gathering and law-enforcing, which are meant to protect Americans, to instead spy on them, to gather information that isn’t the government’s business (at least not without a court’s approval). And, in some instances, it appears, to punish or silence those with whom they disagree ‐ personal and political foes, in and out of government ‐ rather than to pursue and protect Americans from the country’s real enemies.

Perhaps more alarming is the growing evidence that suggests some officials at all levels in intelligence and justice agencies are operating in a way that is clearly intended to serve their own political beliefs and interests ‐ not the public’s interests.

And sometimes, it appears, they operate not just in direct defiance of their superiors but of the Congress, the courts and the very laws of the land as well.

(Almost as disturbing, Congress, for its part, seems all too willing to allow all of this to take place, when it becomes known, rather than using its authority to stop the misfeasance, punish the miscreants who lie or stonewall, and protect their constituents.)

This is not, in my view, a partisan political question. The evidence leading us to ask such a disturbing question indicates there are forces inside our intelligence agencies that are more persistent and powerful than any single political party or administration. They can usurp the intentions of the many fine intelligence officers serving our country.

List follows:

#4  The founding fathers (and behind every great man is a great wife rolling her eyes) feared a powerful federal government. They built protections (i.e. enumerated powers, bill of rights) into the US Constitution to limit abuses. They believed that states, being closer to the people, is where all powers not granted to the federal government belonged.

Then the US Civil War happened and in its aftermath, the states could not be counted on to protect the rights of all of its citizens. Thus started the rise of a powerful central government culminating in what we have today.

Federal power means control of where vast amounts of money are spent. Time to start rolling back Federal power. The Supreme Court can do it in a single stroke by closing the Commerce Clause loophole eliminating the legal bases for circumventing the enumerated powers structure of the US Constitution. That could be followed by a new amendment to the US Constitution which better defines regulating interstate commerce so as to prevent abuses by future Supreme Courts.

Russia establishing permanent presence at its Syria bases: RIA cites minister
[AlAhram] Russia has started establishing a permanent military presence at naval and air bases in Syria, the defence minister said on Tuesday as parliament ratified a deal with Damascus to cement Russian presence in the country, the RIA news agency reported.

The deal, signed on Jan. 18 will expand the Tartus naval facility, Russia's only naval foothold in the Mediterranean, and grant Russian warships access to Syrian waters and ports, Viktor Bondarev, head of the upper house security and defence committee, told RIA.

RIA news agency separately quoted Sergei Shoigu as saying: "Last week the Commander-in-Chief (President Vladimir Putin
...Second and fourth President and sixth of the Russian Federation and the first to remain sober. Putin is credited with bringing political stability and re-establishing something like the rule of law, which occasionally results in somebody dropping dead from polonium poisoning. The old bunch, without close personal ties to Putin, are in jail or in exile or dead...
) approved the structure and the bases in Tartus and in Hmeimim (air base). We have begun forming a permanent presence there."

The Tartus naval facility, in use since the says of the Soviet Union, is too small to play host to larger warships.

According to the RIA report, the agreement will allow Russia to keep 11 warships at Tartus, including nuclear vessels. The agreement will last for 49 years and could be prolonged further.

The Hmeimim air base, from which Russia has launched numerous air strikes in support of Hereditary President-for-Life Bashir Pencilneck al-Assad
Despoiler of Deraa...
during his war with rebels, can now be used by Russia indefinitely, according to the deal.

Turkey to restore Sudanese Red Sea port and build naval dock
[AlAhram] The Sick Man of Europe Turkey
...the only place on the face of the earth that misses the Ottoman Empire....
will rebuild a ruined Ottoman port city on Sudan's Red Sea coast and construct a naval dock to maintain civilian and military vessels, Sudan's foreign minister said on Tuesday, as Ankara expands military and economic ties in Africa.

The restoration at Suakin was agreed during a visit to the ancient port by Ottoman Turkish President Tayyip Erdogan, Foreign Minister Ibrahim Ghandour said.

Making the first trip by a Ottoman Turkish president to Sudan, Erdogan said Turkey had been temporarily granted part of Suakin so it could rebuild the area as a tourist site and a transit point for pilgrims crossing the Red Sea to Mecca.

He said the Suakin deal was one of several, worth $650 million in total, agreed with Sudan, which emerged from two decades of US sanctions in October and is seeking to attract international investment.

The countries also agreed "to build a dock to maintain civilian and military vessels," Ghandour told news hounds, adding that they had signed an agreement "that could result in any kind of military cooperation".

The agreements come three months after Turkey formally opened a $50 million military training base in Somalia as it excerts increasing influence in the region.

Suakin was Sudan's major port when it was ruled by the Ottoman Empire, but fell into disuse over the last century after the construction of Port Sudan, 35 miles (60 km) to the north.

Speaking on Monday in Khartoum, Erdogan said the refurbished port city would attract Mecca-bound pilgrims who would want to see the island's history, helping Sudan's tourism sector.

"Imagine, people from Turkey wishing to go on pilgrimage will come and visit the historical areas on Suakin Island," Erdogan said. "From there ... they will cross to Jeddah by boat."

The other agreements signed during Erdogan's visit include Ottoman Turkish investment to build Khartoum's planned new airport and private sector investments in cotton production, electricity generation and building grain silos and meat slaughterhouses.

Erdogan and Bashir said they aimed for trade between the two countries to reach $10 billion, Turkey's Foreign Economic Relations Board said.

In October, the United States lifted a trade embargo and other penalties that had cut Sudan off from much of the global financial system.

#2  this seems to be one of those magical thinking projects;

a tourist port in Sudan with upscale restaurants and hotels -- Erdogan will, no doubt, coerce some Turkish millionaires into investing in this but it seems to me to be a nearly certain money loser

California salmon lose way after ride downstream in drought
[ABCNews] A desperate decision to truck California's native baby salmon toward the Pacific Ocean during the state's drought may have resulted in generations of lost young salmon now hard-pressed to find their way back to their reproductive grounds.

With fewer native fall-run Chinook salmon able to make their way back home to the leading salmon hatchery in the state, that hatchery could have only about half as many young salmon as usual to release next spring, the Sacramento Bee reported Tuesday.

For those involved in safeguarding California's struggling native salmon, it had always been understood that resorting to tanker trucks to carry tiny salmon to the ocean during the drought was a trade-off, John McManus, executive director of the fishing industry's Golden State Salmon Association, told the Bee. Getting a lift on their migration saved countless salmon, but disoriented them.

"Everybody kind of acknowledged and understood at the time the consequences," McManus said.

Native salmon historically anchored food chains and habitats on both land and in the water in California. Salmon still boost the state's economy by $1.4 billion annually, the salmon industry says.

Dams that cut native salmon off from their former upstream spawning grounds, and general human demands on water, have helped cut salmon numbers drastically in the state, making state and federal hatcheries crucial for the fish.

California's drought, declared over just last spring, included some of the driest spells ever recorded in the state. In 2014 and 2015, hatchery managers resorted to sucking baby salmon into tanker trucks for their 280-mile migration toward the ocean, biologists say. Chinook salmon spend two or three years in the ocean before heading back upstream to reproduce.

Since the 2014 class of salmon didn't learn the route by swimming it on their own power, many have gone astray as they head back upstream now.

Biologists say only a small fraction of those made it back to what would be their usual point of return, at the Coleman hatchery. Salmon managers are tracking now how many of the strayed salmon wound up in other watersheds
Owing that they are a trans-origin species, those attempting were issued a warning for hitchhiking and set free.

#2  It just means less competition for the offspring of those salmon who do recognize their home stream, and therefore a greater survival rate, and more competition for those whose parents took a wrong turn. Those moaning about it forget how very many eggs each salmon lays.

Philippine troops kill 4 militants after Christmas Day attack
[AlAhram] Four pro-Islamic State
...formerly ISIS or ISIL, depending on your preference. Before that al-Qaeda in Iraq, as shaped by Abu Musab Zarqawi. They're very devout, committing every atrocity they can find in the Koran and inventing a few more. They fling Allah around with every other sentence, but to hear the pols talk they're not really Moslems....
turbans were killed in Arclight airstrikes by Philippine troops in a southern province where the rebel group launched a Christmas Day attack, a military front man said on Tuesday.

Members of the Bangsamoro Islamic Freedom Fighters
...a MILF splinter group aligned with the Islamic State...
(BIFF) attacked Datu Unsay town in Maguindanao on Monday, burning two houses and prompting residents to flee, said Captain Arvin Encinas, front man for the 6th Infantry Division.

The latest military operation follows last month's shelling of BIFF button men in support of ground attacks in an area of marshland between the provinces of Maguindanao and Cotabato, about 170 km (106 miles) from Marawi City.

The shellings took place as the military pushes on with a new offensive after the country's biggest urban battle in decades in Marawi, which was occupied for several months by Islamic State loyalists including BIFF fighters.

The turbans' occupation of Marawi and their dogged resistance spread alarm in the region about the rise of extremism and radical aspirations to create an Islamic State caliphate.

Catalonia: How not to deal with a separatist movement
[ARABNEWS] Insanity was once defined as doing the same thing over and over again and expecting different results. In the current period of European political madness, early elections and referendums are being repeatedly used in futile attempts to resolve political crises, as a substitute for vision and leadership. In most cases the results do nothing but highlight the deep divisions, mainly because the root causes of the issues at hand have not been adequately dealt with.

Last Thursday’s elections in Catalonia demonstrated exactly this. Catalan nationalism, whether one likes it or not, was not going to disappear just because the people of the region were asked to vote in an election for their regional Parliament. Rather than strategy, the move smacked of desperation by the central Spanish government and its Prime Minister Mariano Rajoy.

The elections only further demonstrated that Catalans are divided over the issue of separating from Spain. The results cannot be called a decisive victory for the separatist parties, who won 70 of the 135 seats, although they still maintain a majority in the Catalan Parliament. Rajoy, on the other hand, is clearly the big loser. He gambled on voters to do the job for him of killing off the nationalist challenge, and lost. Those parties who do not want to break away from Spain are in a minority in the Catalan Parliament, and Rajoy’s conservative Popular Party recorded its worst ever result; it was all but wiped out, losing 8 of its 11 seats.

These results also highlight that Rajoy’s ill-judged decisions to impose direct rule after the Catalan Parliament declared independence, to go after the members of the Catalan government who supported the region’s independence, and then to call an election, have all backfired. Accusing Catalan President Carles Puigdemont of sedition and rebellion and jailing other members of the deposed Catalan government for similar offenses, was an overreaction made in panic. Turning Puigdemont, a rather lackluster leader, into an almost Che Guevara-style rebel with a European arrest warrant on his head, was only ever going to entrench nationalist resistance to Madrid. Though the arrest warrant was withdrawn last month, the damage had already been done. And now the regional election results have left Spain and Catalonia on the verge of further confrontation, and an out-of-sorts EU facing a major crisis brewing within its borders.
