#2 I agree he probably did not know the pistol was loaded, however he should have checked to make certain. His claim that he didn't pull the trigger is bogus.

#4 Involuntary Manslaughter is defined as: 1) An unlawful killing that was unintentionally caused as the result of wanton or reckless conduct that a defendant engaged in; or 2) An unlawful killing that resulted during the commission of a dangerous battery by a defendant. (Massachusetts State Law.)/em>

State by state the statute probably differs and Baldwin is another Hollywood liberal dirt bag but the charge may not stick as far as the above common legal definition does not apply to the actual event.

1) An unlawful killing that was unintentionally caused as the result of wanton or reckless conduct that a defendant engaged in;
Alec Baldwin chose to 1) Use a functional gun instead of a solid nylon movie prop weapon or other facsimile; 2) Did not check to see that the weapon was unloaded before aiming at a human being; and 3) Baldwin pulled the trigger. Q.E.D. Baldwin had multiple failures of judgment leading to an "unintended death".
