It all depends on the race of the participants. I bet the shooter gets some sort of illegal discharge of unlicensed weapon or at least disorderly conduct on a train.
I don't have much experience criming, but as a general rule, if you get shot with your own gun, you are doing it wrong.

Haven't ordered a drink from a McD in many decades. When I order something there (very rarely nowadays) I drink water or soda that I keep in my car. Most McD's will give you a free cup of ice water.
