#1 I'm not a lawyer, but it seems to me that the United States (and any country) has the right to bar anyone who is not a citizen from entering the country.
Personally, I feel that the fact that foreign scholars and writers are now reluctant to accept invitations to the US as a feature, not a bug.

Not true for EU countries. They have to admit anyone who's a citizen from other EU countries, IIUC.
